Terms of Service - FundedMetrics

These Terms of Service ("Terms") govern your access to and use of FundedMetrics ("the Service"), a trading performance analytics platform. By registering for or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Who We Are

The Service is provided by Riccardo Savoca, operating as a sole trader based in Italy (VAT number available on request). You can contact us at info@fundedmetrics.net.

2. Description of the Service

FundedMetrics is a software tool that allows traders to upload their own trading history (exported as a CSV file from platforms such as Rithmic) and view advanced performance analytics, metrics, and visualisations on a personal dashboard. The Service is an analytics and journaling tool only.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service, you confirm that you meet these requirements.

4. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to notify us promptly of any unauthorised use of your account.

5. Subscriptions, Billing and Cancellation

Access to the Service is provided on a paid subscription basis. Subscriptions are billed in advance through our payment provider, Lemon Squeezy, and renew automatically at the end of each billing period unless cancelled.

You may cancel your subscription at any time from your account or through Lemon Squeezy.
After cancellation, you will retain access to the Service until the end of the period you have already paid for.
Payments already made are non-refundable. We do not provide refunds for the current or previous billing periods, except where required by applicable law.

6. Acceptable Use

You agree not to misuse the Service. In particular, you must not: attempt to gain unauthorised access to the Service or other users' data; upload malicious content; reverse-engineer, copy, or resell the Service; or use it for any unlawful purpose.

7. Not Financial Advice

FundedMetrics is a data analytics tool. It does not provide investment, financial, tax, or trading advice, and nothing in the Service constitutes a recommendation to buy, sell, or hold any financial instrument. Trading involves substantial risk of loss. Past performance is not indicative of future results. You are solely responsible for your own trading decisions and should consult a qualified professional where appropriate.

8. Third-Party Platforms and Trademarks

FundedMetrics is an independent tool and is not affiliated with, endorsed by, or sponsored by Rithmic, LLC or any prop firm or broker. "Rithmic" is a registered trademark of Rithmic, LLC. Any third-party names are used for identification purposes only.

9. Intellectual Property

All content, software, design, and branding of the Service are the property of FundedMetrics and are protected by intellectual property laws. The trading data you upload remains yours; by uploading it, you grant us the limited right to process and store it solely to provide the Service to you.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the analytics produced will be accurate or complete. The accuracy of any metric depends on the quality and completeness of the data you upload.

11. Limitation of Liability

To the maximum extent permitted by law, FundedMetrics and its operator shall not be liable for any indirect, incidental, or consequential damages, including any trading losses, loss of profits, or loss of data, arising from your use of or inability to use the Service. Nothing in these Terms limits any liability that cannot be excluded under applicable law.

12. Termination

We may suspend or terminate your access to the Service if you breach these Terms. You may stop using the Service at any time by cancelling your subscription and closing your account.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Italy. Any disputes arising in connection with the Service shall be subject to the jurisdiction of the competent Italian courts, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
